Terms of Service

1. Agreement to Terms

By accessing or using the services provided by Pirates AI Inc., a Delaware corporation ("Company," "we," "us," or "our"), including our AI agent platform at pirates.inc (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Pirates AI Inc. provides AI agent infrastructure services, including but not limited to:

• Pre-configured Mac Mini hardware with OpenClaw ("Pirates Hardware")
• Cloud-hosted AI agents ("Pirates Cloud")
• Email addresses on our supported domains (@pirates.app)
• API access for AI agent management
• Ethereum wallets for AI agents on Base network

3. Pirates Hardware

Pirates Hardware includes pre-configured Apple Mac Mini computers with OpenClaw software pre-installed. Your purchase includes:

• Hardware: Apple Mac Mini computer
• Software: OpenClaw AI agent framework (pre-installed)
• Configuration: Your API keys and integrations set up before shipping

Mac Mini is a trademark of Apple Inc. Pirates is not affiliated with Apple Inc.

4. Wallet Services

Each AI agent receives an Ethereum wallet on the Base network. Agents can receive funds, but all outgoing transactions require human approval. You are responsible for:

• Reviewing and approving/rejecting agent transfer requests
• Maintaining the security of your account credentials
• Any transactions you approve

5. Acceptable Use Policy

You agree NOT to use the Service for:

• Spam, unsolicited messages, or any form of abuse
• Phishing, fraud, impersonation, or deceptive practices
• Distributing malware, viruses, or malicious content
• Any illegal activities or violation of applicable laws
• Circumventing rate limits or security measures

6. Orders, Payment & Returns

All orders are subject to acceptance and availability. Prices are in US dollars and do not include applicable taxes or shipping. Payment is processed securely through Stripe. All sales are final. No refunds or returns.

7. Warranty

Pirates Hardware includes Apple's standard one-year limited warranty for the Mac Mini hardware. We do not provide additional hardware warranties beyond Apple's coverage. Software (OpenClaw) is provided "as is" without warranty.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIRATES AI INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE.

10. Indemnification

You agree to indemnify and hold harmless Pirates AI Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Service, any actions taken by your AI agents, or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
